Terms of service
To become a member of LPO Locum Services ABN: (LPO Locum hereon) you must read and agree to the terms and conditions set out below together with the privacy policy.
By registering as a member of LPO Locum you agree to the terms and conditions as set out below and as amended from time to time:
1. Definitions for the purposes of this website:
- (a) "Contractor" (Staff) means a member who, for a fee, offers their services on terms and conditions as agreed between the Licensed Post Office and the Contractor (Staff).
- (b) "Owner" “LPO” means a member who owns or is responsible for a Licensed Post Office.
- (c) "Member" means a person who upon payment of the application fee contained on this website or registering on this website agrees to the terms and conditions herein.
2. LPO Locum is an introductory agency only and:
- (a) Will use reasonable endeavours to match a LPO with a relief contractor.
- (b) does not directly or indirectly employ the contractor;
- (c) has the right, in its absolute discretion, to refuse to provide services to a Licensed Post Office or a Contractor (Staff);
- (d) is not involved in the negotiations between members or for supervising the transactions that take place between its members.
- (e) has no control of the contents posted by members and cannot ensure or guarantee the accuracy or legality of any such content; and
- (f) is not involved in the transaction between members and is not a party to any transactions that take place between its members.
3. The contractor (Staff) and Licensed:
- The contractor (Staff) and Licensed Post Office will act reasonably to enter into an agreement whereby the contractor will agree on services required at a price and for a term on terms as agreed. LPO Locum has no responsibility for the terms of the agreement entered nor for the collection of any monies due or payable. The Licensed Post Office and the contractor do not reply upon representations made by or on behalf of LPO Locum and rely entirely upon their own enquiries as to suitability of the contractor to provide services for the LPO.
4. LPO Locum accepts no responsibility for:
- (a) Any incidental, indirect or consequential damages which may occur to any person as a result of using the LPO Locum service, or by any act or omission of a contractor or of any Licensed Post Office
- (b) The behaviour and/or conduct of other members; .
- (c) The suitability, honesty, capability or character of any member; .
- (d) The suitability of the LPO’s premises for the contractors;
- (e) Any incidental, direct, indirect or consequential damage that may be caused to any personal, whether as a result of omission, accident, injury, aggravation or otherwise; and
- (f) Any monies due and payable either by or to the LPO or the Contractor.
5. You irrevocably release LPO Locum:
- You irrevocably release LPO Locum, its directors, and employees absolutely from all liability and responsibility for injury, damages, illness, accident, death, loss of property howsoever arising which may occur to any person at any time as a result of the use of this introductory agency. You agree to indemnify, and keep indemnified, LPO Locum, its directors, and employees from and against all liability, damages, claims, actions and costs of defending such claims and action whatsoever in respect thereof.
6. LPO Locum does not make any warranty as to:
- (a) The suitability, honesty, capability or character of the Contractor;
- (b) The suitability of the Licensed Post Office premises;
- (c) The capability of a contractor to adequately exercise their agreed duties and does not accept any responsibility in relation to these matters
7. LPO Locum is not responsible:
- LPO Locum is not responsible for any computer viruses or breakdowns which may arise as a result of using this service.
8. All correspondence and emails:
- All correspondence and emails that you receive from LPO Locum or a member of LPO Locum are confidential. You are not permitted to forward these emails to another party without first obtaining the consent of the original sender.
9. Travel Costs and expenses:
- Travel Costs and expenses during the booking will be raised and agreed with the Licensed Post Office by the Contractor as they are incurred and paid for by the Owner. All users are responsible for all charges associated with the use of LPO Locum (for example wifi, data).
10. LPO Locum is not responsible for:
- LPO Locum is not responsible for any information or materials posted or transmitted via its website.
11. LPO Locum is not responsible for resolving:
- LPO Locum is not responsible for resolving disputes between members. Contractors are responsible for any Cardholder disputes and for Stripe's fees. These fees can be recouped into the prices you set on your listing for services. Payment matters can be raised with Stripe by submitting a ticket.

12. Members are responsible for:
- Members are responsible for their own online charges from internet service providers and all associated and incidental costs.
13. All members agree that, in relation:
- All members agree that, in relation to personal information of other members that are obtained through this website or through LPO Locum facilitated transaction; that information will not be used for any unsolicited commercial purpose. Members are expressly prevented from adding personal information of other members to any electronic or physical mailing lists, or for sending spam or other content not expressly authorised by LPO Locum.
14. LPO Locum is not responsible:
- LPO Locum is not responsible for any losses or damages that result from loss of user ID and/or password.
15. LPO Locum may, in its absolute:
- LPO Locum may, in its absolute discretion, amend or alter the content of a member profile. This includes but is not limited to the removal of company names, URL links and inappropriate or offensive material as deemed so by us.
16. LPO Locum may, in its absolute:
- LPO Locum may, in its absolute discretion, cancel a membership for any breach of these terms and conditions as amended from time to time.
17. LPO Locum may amend the terms and conditions:
- LPO Locum may amend the terms and conditions from time to time. If you do not agree with any of our terms and conditions, you must terminate your membership. If, after changes to our terms and conditions you continue to be a member of LPO Locum, you will be considered to have accepted the varied terms and conditions.
18. As part of using this site:
- As part of using this site, you agree that your details will be cross-checked and if membership is deemed not appropriate by LPO Locum staff or the Licensed Post Office, then your membership will be terminated.
19. By becoming a Contractor:
- By becoming a Contractor or offer Relief Services through LPO Locum, you agree that you are 18 years of age or that you have permission and supervision from your parents. LPO Locum takes no responsibility for any child who has not requested permission and supervision.
20. As a Contractor:
- As a Contractor, I agree that I will not refer or discuss any users to any other platform as I realise LPO Locum spends time & money in working to promote Contractors. If I choose to violate these conditions, LPO Locum Admin may choose to terminate my membership permanently.
21. As a Licensed Post:
- As a Licensed Post Office owner I agree to pay for any bookings I make up front before contractor begins. In not doing so, I take full responsibility for all costs incurred, should my booking be cancelled for non-payment.
22. If I run a LPO contracting business:
- If I run a LPO contracting business on LPO Locum, I agree to displaying a clear personal profile picture. and agree that I will not display my business name or logo on my listing, as I accept that LPO Locum is built on personal relationships and trust.
23. Financial Onboarding with Stripe:
- Financial Onboarding with Stripe In order to receive payouts, all contractors must complete financial onboarding with LPO Locum’s Financial Services Partner, Stripe.
24. Ongoing Relationship:
- Ongoing Relationship with LPO Locum. As a Contractor I agree that I have an ongoing relationship with LPO Locum and every booking, including subsequent bookings with the same Licensed Post Office (Owner) must go through the LPO Locum platform.
25. Payments:
- As a Licensed Post Office, when you provide payment information, you represent and warrant that the information is accurate, that you are authorised to use the payment method provided.
- The Contractor is responsible for displaying the 'Make Payment' button to LPOs. Payment must be requested from LPO’s Credit Card before the service begins via LPO Locum in the Message thread.
- LPO Locum uses the 3rd party payment platform, Stripe, and in conjunction, your Stripe account to process credit and debit card transactions for your LPO Locum account.
- LPO Locum is a "Partner Application" as defined in the Stripe Terms of Service and you expressly understand and agree that LPO Locum shall not be liable for any payments and monetary transactions that occur through your use of the Service. You expressly understand and agree that all payments and monetary transactions are handled by Stripe.
- You agree that LPO Locum shall not be liable for any issues regarding financial and monetary transactions between you and any other party, including Stripe.
- You are responsible for all transactions (one-time, recurring, and refunds) processed through the Service and/or Stripe. LPO Locum is not liable for loss or damage from errant or invalid transactions processed with your Stripe account. This includes transactions that were not processed due to a network communication error, or any other reason. If you process a transaction, it is your responsibility to verify that the transaction was successfully processed.
- You understand that LPO Locum uses the Stripe platform to run the Service and that the Stripe platform is subject to change at any time and such changes may adversely affect the Service. You understand and agree to not hold LPO Locum liable for any adverse effects that actions (whether intentional or unintentional) on the part of Stripe may cause loss to your Stripe account, your LPO Locum account, or your business.
- You must not process stolen credit cards, or unauthorised credit cards through Stripe and/or your LPO Locum account.
26. REFUNDS AND CANCELLATIONS POLICY:
- Users understand and acknowledge that the Relief Services may be subject to statutory guarantees under Australian Consumer Law and any other applicable laws. Nothing in these Terms operates to exclude or limit the operation of such guarantees in any manner contrary to law.
- Contractors (Staff) are responsible for handling all Customer refunds. Upon agreeing to refund, for the Contractor’s own cyber security protection, the transaction must be reversed in Stripe by the Contractor and never refunded in cash or into a Cardholder’s alternate bank account.
- Cancellation by a Relief Contractor service provider: If a contractor cancels prior to start or during a booking, we will refund the booking fees paid by the Licensed Post Office for the services not provided. LPO Locum will try to arrange a substitute contractor to cover a confirmed booking.
- A contractor may contact LPO Locum to try to find an alternate service provider to cover for any remaining days with mutual agreement of all the parties involved including LPO Locum to modify the booking and ensure a seamless experience.
- If you are a contractor and you frequently cancel confirmed and accepted bookings without any justifications, LPO Locum reserves the right to terminate your account.
- Cancellation by a Licensed Post Office: If a LPO (owner) cancels prior to the start of a booking then the Contractor’s chosen refund policy at the time of creating that booking will apply, booking fee is non-refundable to compensate LPO Locum. The LPO must notify LPO Locum in writing at lpo.locum@gmail.com. LPO Locum’s representative will consider notice receipt time, circumstances of the complaints, withholding period of booking amount, contractor’s refund policy or any other relevant factors before processing any refunds. Three types of refund policies which a contractor, as a provider of relief services, can choose are below;
- Conditions for FULL Refunds:
- Flexible Policy: LPO (owner) is eligible for a full refund if LPO Locum receives the cancellation request 24hours before the commencement of the booking.
- Moderate Policy: LPO (owner) is eligible for a full refund if LPO Locum receives the cancellation request 7 days before the start of a booking.
- Strict Policy: LPO (owner) is eligible for a full refund if LPO Locum receives the cancellation request 14 days before the start of a booking.
- Peak Period Policy: Any booking confirmed between 28th November and 7th Jan next year will be non-refundable to compensate contractor’s for the lost opportunities during peak season.
- Capped Partial Refunds: Where a LPO (owner) is not eligible for a full refund, LPO Locum will forfeit 50% or A$300 whichever is lower over and above booking fee. This is a cost to cover contractor’s compensation, administration expenses to set the booking, maintenance of website, advertising, and other related costs.
- If a LPO cancels a current booking (after the start but before the end date), we will refund the service fee paid by the LPO for the services not yet provided subject to the Capped Partial Refunds clause above.
- Refunds after a payout: The contractor will get paid after LPO confirms completion of a booking on LPO Locum or 24 hours after booking end time. Cancellation request/complaints received after payment has been made to the contractor will warrant discussions with both parties and will involve recovery of paid funds from the contractor. LPO”s understand that any delays of refunds from contractors are beyond the control of LPO Locum.
- Cancellation of Recurring Bookings: weekly recurring bookings that run for more than 2 weeks and for which LPO Locum collects weekly payments. All the above policies will apply in cases where booking is cancelled before its start date except the amount in consideration will be for 2 weeks.
- Force Majeure: The cancellation policies described herein may not apply in the event of certain emergency situations beyond the control of Contractor’s/ Licensed Post Offices that make it impossible or impractical to perform agreed Bookings, such as evacuations resulting from earthquake, hurricane, bushfire, flood, war, riots, pandemic situation, or other similar disaster. In such cases LPO Locum may, in its reasonable discretion, issue refunds under terms that vary from a Contractor’s selected cancellation policy.
27. Inactive Accounts:
- LPO Locum incurs administrative and other costs to maintain its digital wallet and website. Any unused balance in a wallet will be reset to zero when an account becomes Inactive. An inactive account is any wallet without transaction in the last 12 months.
- Privacy Policy
- LPO Locum manages the information that we collect from you in accordance with applicable privacy legislation. In this Policy, "LPO Locum", "we", "our" and/or "us" means
- (i) where you reside in any country in the European Economic Area, and
- (ii) where you reside anywhere outside the European Economic Area: LPO Locum Pty Limited, an Australian company.
- This Privacy Policy describes how LPO Locum collects, uses, shares and handles your personal data, and sets out the rights and obligations that both you and LPO Locum have in relation to your personal data.
- By accessing https://www.lpolocum.com.au (together, the "Services") you accept and agree to the Terms of Service of LPO Locum's user agreement ("User Agreement"), and acknowledge that your personal data may be collected, used and disclosed in accordance with this Privacy Policy. Except for any terms that are defined in this Privacy Policy then all other defined terms shall have the same meaning as that defined in the User Agreement. Note that under LPO Locum’s Terms of service you must not use the Services if you are under 18 years old.
- LPO Locum may, from time to time, modify this Privacy Policy (and update the web page on which it is displayed). If we materially change the ways in which LPO Locum uses or shares your personal data previously collected from you through the Services, LPO Locum will notify you through your LPO Locum account, your registered email address or other communication. You should check that account regularly.
- 1. Collection of Your Personal Data Information we collect directly from you
- LPO Locum collects personal data when you pre-register with LPO Locum. This includes your full name, email address and location. In circumstances where the below information is not provided to us, we may be unable to provide the Services to you and carry out our contractual obligations with you.
- LPO Locum collects personal data when you register with LPO Locum. This includes:
- 1. your name, address, email address, phone number and other contact details;
- 2. your birth date;
- 3. your credit card and account details, which are processed by a third-party service provider that handles payments for us;
- 4. your location and the location where you are interested in performing tasks; and
- 5. your occupation, work experience, resume, qualifications, education, post tasks, earn money preferences, skillset, interests and other information relevant for your fitness for tasks.
- If you register in certain countries, we also give you the option of providing a photo or video to be associated with your LPO Locum user ID. If your personal details change, it is your responsibility to update your LPO Locum account with those changes, so that we can keep our records complete, accurate and up to date.
- To enable us to improve our existing services, to create new service features, and to serve you and others with targeted marketing communications, LPO Locum collects information about the way you use the Services, including the transactions you enter into on the Services, your feedback rating (including any references requested using our 'Reference' feature), the bids you make, the comments you post, and the transactions you enter into with our valued affiliate service providers.
- You may apply through our job application submission form provided by a third-party service provider. If you do so, we collect the information you make available to us through your application submission, such as your resume, links to other online profiles, and other information you choose to provide.
- Information we collect automatically when you use the Services
- LPO Locum may also receive and record the following information from your internet browser and computer, including through cookies and similar technologies, when you use the Services:
- 1. Computer and connection information such as statistics on page views, traffic to and from the Services, referral URL, IP address, unique device ID, browsing history and web log information; and
- 2. Information about your use of the Services, including the date and time you visit the Services, the areas or pages that you visit, the amount of time you spend viewing or using the Services, the number of times you return to the Services, other clickstream or website usage information, and emails that you open, forward or click-through to the Services.
- If you use a location-enabled LPO Locum service, if you allow us, we receive and process information about your precise location (for example, through GPS signals sent by your mobile device). We may also collect the precise location of your device when the app is running in the foreground or background or when the app is closed. We may also use a range of different technologies to confirm your location. When you use the Services, we also infer the general location of your device and the geographic regions our users come from. For example, your IP address may indicate your general geographic region.

- Information we obtain from other sources.
- In addition to data collected from your submissions, we also receive data from certain third parties, such as social media sites that you connect to your account (including Facebook, LinkedIn, Twitter and any other site you which you enable from time to time) as well as from identity verification service providers and other LPO Locum group companies.
- We work with third party verification providers to perform police history checks or background checks on taskers and receive publicly available information such as court decisions.
- We may also receive additional information about you from third parties such as data or marketing partners and combine it with other information we have about you.
- What other information users can see about you
- You are not anonymous to us when you log into the Services or post any content (including tasks, items to be supplied, bids, comments or feedback) on the Services or any associated forum.
- When you:
- 1. use the services to post a task or item to be supplied, or make a bid, or comment on a bid, or provide feedback on other users; or
- 2. otherwise communicate in a public forum on the Services,
- your user ID and all the material that you post is visible and searchable to us, other LPO Locum users and is also publicly available to other internet users. We strongly encourage you to use caution and discretion when posting and carefully consider whether and what to post or how you identify yourself on the services.
- LPO Locum does not in any way control and does not accept any responsibility or liability whatsoever for, the disclosure or use of personal data which is voluntarily posted by you in a publicly accessible area of the services.
- 2. How We Use Your Personal Data
- LPO Locum may use the information we collect for the following purposes: Identification and authentication Legal ground(s) for use: We need to perform this function in order to allow you to access the Services. To protect LPO Locum and the users of the Services Legal ground(s) for use: It is in our (and users) legitimate interests to ensure that the Services are secure. To customise the content and any advertising displayed on the Services and permit content on the Services (such as postings, marketing or third party advertisements) to be targeted, on an aggregate basis, to the users for whom it is most likely to be relevant Legal ground(s) for use: It is in our legitimate interest to provide you with content and advertisements that are tailored to your interests.
- To improve the Services and develop new service features
- Legal ground(s) for use: We need some of your personal data in order to provide the services to you; it is in our legitimate interests to provide you the best possible services.
- To provide, maintain and protect the Services and to verify the identity of authorised users of the Services.
- Legal ground(s) for use: We need to perform this function in order to provide a safe and secure environment for our users and we have legitimate interests in protecting the integrity of the Services we offer.
- Providing your information to a user with whom you have or had a contract facilitated by LPO Locum
- Legal ground(s) for use: We need to use your personal data in this way to provide the Services you request.
- As required by law, order of a court, tribunal, or regulator or if LPO Locum reasonably believes that the use or disclosure of the information is reasonably necessary for enforcement related activities.
- Legal ground(s) for use: On such occasions, we are required by law to process your personal data.
- To ensure that LPO Locum receives payment of the fees due to it Legal ground(s) for use: We need to use your personal data in this way to fulfil a contract between you and us
- To contact you to inform you about promotions or upcoming changes or improvements to the Services.
- Legal ground(s) for use: We only contact you for marketing purposes with your consent; we may contact you regarding changes in the Services because it is in our legitimate interests to keep you informed about service changes that may affect you. - To contact you to Administer our User Agreement
- Legal ground(s) for use: For example, we may notify you of a breach, or action a request for a take down notice in response to a claim of copyright infringement.
- To Conduct Research
- Legal ground(s) for use: It is in our legitimate interests to improve the Services through user questionnaires and feedback requests via the Services.
- To Expand our user base, including marketing communications to be targeted to potential users
- Legal ground(s) for use: It is in our legitimate interest to inform potential users about the Services we offer.
- To develop our relationships with affiliate service providers and provide or arrange internal or external verification services obtained by you via the Services
- Legal ground(s) for use: It is in our legitimate interests to engage service providers and verification services.
- To generate data reports on an aggregated, non-personally identifiable basis, for both internal and third party use, but subject to any applicable laws (for example, we may show advertisers or investors trends relating to the general use of the Services); and
- Legal ground(s) for use: It is in our legitimate interests (and the interests of our partners and affiliates) to understand how you and other users engage with the Services.
- Your contact information may also be used for accounting, invoicing and billing purposes, marketing purposes, by third party service providers to LPO Locum, and to respond to any enquiry you make
- Legal ground(s) for use: It is in our legitimate interests to engage service providers to assist us in delivering the Services you request.
- When you contact LPO Locum, we may keep a record of the communication(s) between you and LPO Locum to help resolve any issues you might have
- Legal ground(s) for use: We retain information when we are required to do so by law and because it is in our legitimate interests to protect our legal rights.
- If other user(s) of the Services already have your userID (or other information identifying you), and you have chosen to upload a photo or other personal data to your LPO Locum account, we may show those user(s) that personal data.
- Legal ground(s) for use: We display your photo to other users who have your userID only with your consent, which you supply by uploading your photo.
- The Services allow you to review your experience dealing with others on the Services, who may in turn leave reviews about you. We compile these reviews to provide an aggregate rating for each user, which will publicly appear along with your profile. Please be aware that other users may rely on this rating when deciding whether to engage with you.
- Profiling and data analytics
- We (or our service providers on our behalf) may collate information about you and your preferences, to identify market segments and use that information for data analytics and direct marketing.
- We (or our service providers on our behalf) may use your name, street address, email address, phone number, and data collected from cookies and similar technologies about how you use the Services (including tasks created and certain actions taken on the site) to conduct data analytics, including the creation of look-alike audiences. We use the results of data analytics for marketing, product and service development, and policy development.
- We do not use sensitive information for data analytics.
- 3. Cookies and Similar Technologies
- LPO Locum uses cookies and similar tracking technologies for a number of purposes including to access your information when you sign in, keep track of your preferences, direct specific content to you, report on LPO Locum user base, and to improve LPO Locum services. We also use cookies or anonymous identifiers when you interact with our affiliate service providers (for example, when you integrate your LPO Locum account with your Facebook profile) and as further described below.
- We use the following types of cookies and similar technologies:
- Strictly Necessary Cookies
- We use cookies and similar technologies that are necessary to the operation of the Services. This includes technologies that allow you access to our website, services, mobile app or that are required to identify irregular site behaviour, prevent fraudulent activity and improve security, or that allow you to make use of our functions such as saved search or similar functions;
- If you change the settings on your internet browser to block or restrict cookies (including cookies associated with the Services), or to indicate when a cookie is being set by LPO Locum, the Services may not work as intended. You should remember that, while you may still be able to use the Services if your cookies are disabled, the Services may not function properly on your device and you may not be able to take advantage of certain LPO Locum features.
- Functionality Cookies
- We use cookies and similar technologies that allow us to offer you enhanced functionality when accessing or using the Services. This may include identifying you when you sign into our website, keeping you signed in as you browse or keeping track of your specified preferences, interests, or past items viewed so that we may enhance the presentation of content on our website and mobile app.
- Performance Analytics Cookies
- We use cookies and similar technologies to assess the performance of the Services. We use this information to analyse and help us understand how you and other visitors use the Services so we can improve the content or layout of the Services. We also use this information to track the number of our visitors and analyse the popularity of the features we offer.
- Advertising Cookies
- We may use first-party or third-party cookies and similar technologies to deliver content, including ads relevant to your interests. This includes using technologies to understand the usefulness to you of the advertisements and content that has been delivered to you, such as whether you have clicked on an advertisement.
- You may reject first-party advertising cookies and similar technologies through your browser settings (as described below). - Browser and System Controls
- You may set your browser or operating system to limit certain tracking or to decline cookies, but you may not be able to use certain features on the Services which require such cookies. Each browser and operating system is a little different, so please check your browser or operating system's settings or help section to learn more about how to delete or disable cookies and tracking.
- If you wish to prevent your data from being used by Google Analytics, Google has developed the Google Analytics opt-out browser add-on available here, and you can manage your Google accounts here.
- 4. How We Share Your Personal Data
- LPO Locum may disclose the information We collect from you as follows:
- 1. LPO Locum Affiliates. We may share your personal data with our affiliated companies
- 2. Service Providers. We share your personal data with third party service providers that provide business, verification, professional or technical support functions for us, help us operate our business and the Services, or administer activities on our behalf.
- 3. Analytics Partners. We use analytics services such as Google Analytics to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/ and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.
- 4. Advertising Partners. We work with third party advertising partners to show you ads that we think may interest you. Some of our advertising partners are members of the Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info). If you do not wish to receive personalised ads, please visit their opt-out pages to learn about how you may opt out of receiving web-based personalised ads from member companies. You can access any settings offered by your mobile operating system to limit ad tracking, or you can install the AppChoices mobile app to learn more about how you may opt out of personalised ads in mobile apps.
- 5. Other Third Parties. We may share your personal data with other third parties who participate in LPO Locum marketing initiatives, as authorised by you or on an aggregate basis, and with consultants, advisors and analytics providers as necessary to measure and improve the Services we provide to you. We do not rent, sell, or share information about you with non-affiliated third parties for their direct marketing purposes, unless we have your permission.
- 6. OSharing Between Users. We may share information, such as ratings and reviews about you, with other users who are looking for taskers on the Services.

- To enable us to improve our existing services, to create new service features, and to serve you and others with targeted marketing communications, LPO Locum collects information about the way you use the Services, including the transactions you enter into on the Services, your feedback rating (including any references requested), the bids you make, the comments you post, and the transactions you enter into with our valued affiliate service providers.
